Where an order is cancelled because payment cannot be properly authorized, any applicable payment hold or authorization should be released according to the payment provider's procedures.

Estimated shipping and delivery times are estimates unless expressly stated as guaranteed.

Nothing in these Terms eliminates any refund, replacement, cancellation, warranty, or other remedy that applicable law requires BuzzBlock to provide.


17. CANCELLATIONS

We will make reasonable efforts to accommodate cancellation requests received before fulfillment or shipment.

Once an order has entered fulfillment or shipment, cancellation may no longer be possible.

Where applicable law provides a cancellation right, that right will not be limited by this provision.


18. PROMOTIONS AND DISCOUNTS

Promotional offers may be subject to additional terms.

Unless otherwise stated:

  • Promotions cannot be combined;

  • Promotional codes may expire;

  • Promotions may be limited to one use per customer;

This section does not prohibit lawful resale rights that cannot legally be restricted.

23. AUTOMATED ACCESS AND SCRAPING

Unless expressly authorized by BuzzBlock, you may not use bots, crawlers, spiders, scrapers, scripts, or other automated systems to:

  • Extract substantial portions of website content;

  • Monitor prices at scale;

  • Harvest customer information;

  • Circumvent technical restrictions;

  • Generate fraudulent orders;

  • Overload the Services; or

  • Interfere with website functionality.

This restriction does not apply to lawful search-engine indexing or other automated access that BuzzBlock expressly permits.


24. INTELLECTUAL PROPERTY

The Services and their contents may include:

  • Trademarks;

  • Logos;

  • Product names;

  • Text;

  • Graphics;

  • Photographs;

  • Videos;

  • Designs;

  • Software;

  • Code;

  • Layouts;

  • Icons;

Except as expressly permitted by BuzzBlock or applicable law, these materials may not be:

BuzzBlock and associated branding are property of their respective owners.

No license is granted merely by accessing the website.


25. TRADEMARKS

BuzzBlock names, logos, branding, slogans, and other marks may constitute trademarks or trade dress.

You may not use BuzzBlock marks in a manner likely to:

  • Cause confusion;

  • Suggest sponsorship;

  • Suggest endorsement;

  • Suggest affiliation; or

  • Misrepresent the source of products or services.


26. USER-GENERATED CONTENT

If BuzzBlock allows users to submit:

  • Reviews;

  • Photos;

  • Videos;

  • Comments;

  • Testimonials;

  • Questions;

  • Feedback; or

  • Other content,

you retain ownership of your content except to the extent otherwise agreed.

By submitting content, you grant BuzzBlock a non-exclusive, worldwide, royalty-free license to host, reproduce, display, format, and use the content for purposes reasonably associated with operating, marketing, improving, or promoting the Services, subject to applicable law.

You represent that:

  1. You own or have permission to submit the content;

  2. The content does not unlawfully infringe another person's rights;

  3. The content is not fraudulent;

  4. The content is not knowingly false or misleading;

  5. You have authority to grant the applicable license; and

  6. The content complies with applicable law.


27. HONEST REVIEWS

Nothing in these Terms prohibits or penalizes a consumer from expressing an honest opinion about BuzzBlock, its products, services, or conduct.

BuzzBlock will not condition a consumer's purchase or refund rights on providing a positive review.

BuzzBlock does not require customers to remove honest negative reviews.

Federal law prohibits certain contractual provisions that restrict consumers from giving honest reviews of products or services.


28. FEEDBACK

If you voluntarily provide suggestions, ideas, recommendations, or other feedback regarding BuzzBlock, you grant BuzzBlock permission to use that feedback for legitimate business purposes without compensation, subject to applicable law.

BUZZBLOCK DOES NOT WARRANT THAT:

  • THE WEBSITE WILL ALWAYS BE AVAILABLE;

  • THE WEBSITE WILL BE ERROR-FREE;

  • THE WEBSITE WILL BE COMPLETELY SECURE;

  • INFORMATION WILL ALWAYS BE CURRENT OR ERROR-FREE;

  • DEFECTS WILL ALWAYS BE CORRECTED IMMEDIATELY; OR

  • THE SERVICES WILL MEET EVERY INDIVIDUAL USER'S EXPECTATIONS.

HOWEVER, NOTHING IN THIS SECTION DISCLAIMS ANY WARRANTY OR RIGHT THAT CANNOT LAWFULLY BE DISCLAIMED OR LIMITED.

39. LIABILITY CAP

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BUZZBLOCK'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO A PARTICULAR ORDER OR THE SERVICES WILL NOT EXCEED THE GREATER OF:

  1. THE AMOUNT ACTUALLY PAID BY YOU TO BUZZBLOCK FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM; OR

  2. THE AMOUNT REQUIRED BY APPLICABLE LAW.

THIS LIMITATION DOES NOT APPLY TO LIABILITY THAT CANNOT LEGALLY BE LIMITED.


40. EXCEPTIONS TO LIABILITY LIMITATIONS

Nothing in these Terms limits liability to the extent such limitation is prohibited by applicable law.

This includes, where applicable:

  • Fraud;

  • Intentional misconduct;

  • Certain grossly negligent conduct;

  • Non-waivable consumer rights;

  • Liability that cannot legally be excluded;

  • Certain statutory violations; or

  • Other legally protected claims.


41. INDEMNIFICATION

To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless BuzzBlock and its owners, officers, employees, contractors, affiliates, and service providers from claims, liabilities, damages, losses, and reasonable expenses arising out of:

  • Your material breach of these Terms;

  • Your unlawful use of the Services;

  • Your fraud or intentional misconduct;

  • Your violation of another person's rights;

  • Your unauthorized use of the Services; or

  • Content you submit that unlawfully infringes another person's rights.

This indemnification obligation does not apply to the extent the claim resulted from BuzzBlock's own conduct for which indemnification cannot legally be required.


42. FORCE MAJEURE

BuzzBlock will not be responsible for failure or delay caused by circumstances beyond its reasonable control.

  • Hurricanes;

  • Floods;

  • Wildfires;

  • Earthquakes;

  • Severe weather;

  • War;

  • Terrorism;

  • Government action;

  • Public emergencies;

  • Infrastructure failures;

  • Internet outages;

  • Carrier disruptions;

  • Labor disruptions;

  • Cybersecurity incidents caused by third parties; or

  • Other extraordinary circumstances beyond reasonable control.

This provision does not eliminate any consumer refund, cancellation, or other right that applicable law requires BuzzBlock to provide.


43. FRAUD AND ABUSE

BuzzBlock reserves the right to investigate and take appropriate action concerning suspected:

  • Payment fraud;

  • Identity fraud;

  • Promotional abuse;

  • Return fraud;

  • Chargeback abuse;

  • Account abuse;

  • Automated purchasing;

  • False delivery claims;

  • Counterfeit returns;

  • Unauthorized resale; or

  • Other unlawful or abusive activity.

Where permitted by law, BuzzBlock may suspend or terminate access to the Services associated with fraudulent or abusive activity.

This does not authorize BuzzBlock to deny a legally required consumer remedy.


44. CHARGEBACKS

We will make reasonable efforts to investigate billing and fulfillment disputes.

Nothing in these Terms prohibits you from exercising any rights available under applicable payment-card rules or law.

However, initiating a payment dispute does not automatically invalidate an otherwise valid transaction or prevent BuzzBlock from responding to the dispute through the applicable payment network.


45. ACCOUNT SUSPENSION OR TERMINATION

BuzzBlock may suspend or terminate an account where permitted by law if we reasonably believe that:

  • The account is being used fraudulently;

  • The user has materially violated these Terms;

  • The account creates a security risk;

  • The account is being used for unlawful purposes;

  • The account is being used to abuse promotions; or

  • Suspension is necessary to comply with law.

Termination does not eliminate rights or obligations that accrued before termination.


46. TERMINATION OF SERVICES

BuzzBlock may discontinue or modify the Services at any time.

If a discontinuation affects an existing paid obligation, BuzzBlock will provide any refund or other remedy required by applicable law.


47. GOVERNING LAW

These Terms will be governed by the applicable laws of the jurisdiction identified in the final version of these Terms, without giving effect to conflict-of-law principles to the extent permitted by law.

However, nothing in this section is intended to deprive a consumer of mandatory protections provided by the law that applies to the consumer's transaction.

Important: The specific governing-law state should be finalized based on BuzzBlock's actual legal entity, principal place of business, and business structure before publication.


48. DISPUTE RESOLUTION

If a dispute arises, the parties are encouraged to first attempt to resolve the matter informally.

The parties may attempt to resolve the dispute through good-faith communication before pursuing formal proceedings.

Nothing in this section prevents a consumer from exercising a non-waivable statutory right or remedy.


49. ARBITRATION

If BuzzBlock elects to include a mandatory arbitration provision, the final arbitration clause should be adopted only after confirming:

  • The identity and location of the contracting entity;

  • The governing law;

  • The applicable arbitration provider;

  • Consumer arbitration rules;

  • Required disclosures;

  • Applicable state law;

  • Federal Arbitration Act applicability; and

  • Whether the particular transaction and consumer relationship permit such a provision to be enforced.

No mandatory arbitration provision is intentionally created by this section until those details are finalized.

This is deliberate: an incorrectly drafted arbitration clause can create litigation over the clause itself rather than providing meaningful protection.


50. CLASS ACTIONS

To the extent permitted by applicable law, BuzzBlock may seek to require disputes to be brought on an individual basis rather than as a class action.

However, the enforceability of a class-action waiver depends on the specific transaction, applicable law, contract formation, and circumstances.

Accordingly, any final class-action waiver should be reviewed together with the final arbitration and governing-law provisions before publication.


51. SMALL CLAIMS

Nothing in these Terms is intended to prevent a consumer from pursuing an otherwise available claim in a court of competent jurisdiction where applicable law permits such a proceeding.

Where legally permissible, the parties may agree that qualifying individual disputes may be brought in small-claims court.


52. STATUTORY CONSUMER RIGHTS

Nothing in these Terms is intended to waive or limit consumer rights that cannot legally be waived.

This includes applicable rights under:

  • Federal consumer-protection law;

  • State consumer-protection law;

  • Applicable privacy laws;

  • Warranty laws;

  • Payment laws;

  • Shipping laws;

  • Return/refund laws; and

  • Other mandatory consumer protections.
